These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Reliabletrader ("Company," "we," "us," or "our"), concerning your access to and use of our website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site") and our digitization services.
You agree that by accessing the Site and using our services, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. Service Description
Reliabletrader provides digitization services including but not limited to VHS tape conversion, photo scanning, document digitization, and related preservation services. Our services involve the conversion of analog media to digital formats using professional equipment and processes.
User Responsibilities
When using our services, you agree to:
- Provide accurate and complete information when placing orders or communicating with us
- Ensure that any materials you send us for digitization are owned by you or you have proper authorization to digitize them
- Package materials properly when shipping to prevent damage during transit
- Respond promptly to our communications regarding your order
- Pay all applicable fees as agreed upon at the time of order
Intellectual Property Rights
Our Content
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

We do not claim any ownership rights over your original materials or the digital files created from them.
You represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize us to digitize any materials you provide to us. You are solely responsible for ensuring that you have proper authorization to digitize copyrighted materials.
Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:
- Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us
- Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means
- Circumvent, disable, or otherwise interfere with security-related features of the Site

Order Processing and Payment
Pricing
All prices for our services are listed on our website and may be subject to change without notice. We reserve the right to modify prices at any time, but price changes will not affect orders that have already been placed and confirmed.
Payment Terms
Payment is typically due upon completion of services, before delivery of digital files or return of physical materials. We accept various forms of payment as indicated on our website. All payments are processed securely through our payment providers.
Order Confirmation
After placing an order, you will receive an order confirmation email. This confirmation constitutes acceptance of your order and creates a binding agreement between you and Reliabletrader for the services described.
Shipping and Handling
When shipping materials to us for digitization, you are responsible for ensuring proper packaging to prevent damage during transit. We recommend using insured shipping services with tracking for all materials. We are not responsible for any damage or loss that occurs during shipping to our facility.
For return shipping of your original materials, we use standard insured shipping methods unless you request and pay for alternative shipping options. Risk of loss transfers to you upon delivery to the shipping carrier for return shipment.
Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
While we take great care in handling your materials, due to the fragile nature of many analog media formats and the unpredictable effects of age on such materials, we cannot guarantee success in every case. Our liability is limited to the fees paid for the specific service in question.
Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of our services; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights.
Governing Law
These Terms shall be governed by and defined following the laws of the State of North Carolina, United States. Reliabletrader and yourself irrevocably consent that the courts of North Carolina shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.
Dispute Resolution
Any disputes arising out of or relating to these Terms of Use or our services shall first be attempted to be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the appropriate courts as described in the Governing Law section above.
